These terms and conditions govern the use of services made available through. aaaduty.com or the AAA DUTY mobile application. The guidelines, additional or supplemental terms, policies, or disclaimers made available or issued by us from time to time The privacy policy and the supplemental terms form an integral part of these terms. In the event of a conflict between these terms and the supplemental terms with respect to applicable services, the supplemental terms will prevail.

By using the services, you agree that you have read, understood, and are bound by these terms, as amended from time to time, and that you will comply with the requirements listed here. These terms expressly supersede any prior written agreement with you. If you do not agree with these terms and conditions or comply with the requirement, then please do not use the services.

SERVICES

(A) The services include the provision of the platform that enables you to arrange and schedule different home-based and road-based services.

(B) The platform is for your personal and non-commercial use only, unless otherwise agreed upon in accordance with the terms of a separate agreement. Please note that the platform is only for India. You agree that if you use the services from a legal jurisdiction other than India's territory, you will be deemed to have accepted the AAA Duty terms and conditions for that jurisdiction.

(C) AAA DUTY is able to send you text messages, emails, or WhatsApp messages in connection with your number of requests, your usage of the services, or as a part of its promotional and marketing strategies. If you do not want those messages and texts to be received, please contact AAA Duty Customer Care.

(D) In some cases, you may be required to provide proof of your identity in order to use the services, and you hereby agree to do so.If you do not agree to do so, it may result in your inability to use the services.

ACCOUNT CREATION

(A) To use the services of ours, you need to create an account on the platform. For this account, you need to fill out some certain details, and you should be at least 18 years of age.

(B) The information in your account should be accurate and true. You agree to promptly update your details on the application if any changes or modifications are needed.

(C) You are responsible for the security and confidentiality of your account and agree to notify us immediately of any disclosure or unauthorised use of your account.

(D) You agree to receive communications from us regarding requests for payments, information about us and our services, promotional offers, and any other matter related to our services.

USER CONTENT

(A) Our application contains interactive features and services that allow users who have created accounts to post, upload, publish, or submit comments, reviews, feedback, or other content on the Platform.

(B) We may ask you to provide reviews about the services for quality control purposes, and you agree and acknowledge that the services may provide reviews about you for use.You must not give false reviews, feedback, or misleading information about the services. Your reviews will be used for quality control purposes for the services provided by AAA Duty.

REQUEST BY THE CUSTOMER

(A)Request: The platform permits you to request various services at a time of your choosing based on an available time slot. We use reasonable efforts to enable you to find a service provider who is able to provide those services at your requested time and place. If we are unable to serve you the services at your requested time, then we will serve you the services at an alternative date and time.

(B) Confirmation:  Once you place a request, we will notify you of the confirmation of the request via text messages, email, or a push notification. You will receive a confirmation message in the application, via text message, or via email once a service professional has been identified for the requested services.

(C) Cancellations: If the booking in the platform is cancelled prior to our confirmation, it is not chargeable; AAA Duty's cancellation policy specifies the applicable cancellation fee.

(D) Alternative: In case of unavailability or cancellation of your service by the technician or service professionals, we will substitute the service on an alternative date or among our registered service professionals.

PRICING, FEES AND PAYMENT TERMS

(A) AAA DUTY reserves the right to charge you for various services you may use on the platform from time to time.

(B) AAA Duty shall notify you about the applicable charge, fees, and payment method at the time of booking a service. Generally, you can make payments via UPI; the charges and fees are payable at the time of booking a request.

(C) Taxes: All charges and fees are inclusive of applicable taxes.

(D) Charges and fees you pay are non-refundable unless otherwise determined by AAA Duty or required by applicable laws.

(E) You acknowledge and agree that charges and fees applicable to certain geographical areas may increase substantially during times of high demand.

(F) You may cancel your request for professional services at any time prior to such professional services, but we will deduct the cancellation charges and refund the remainder to the customer's bank account.

CUSTOMER CONDUCT

(A) AAA DUTY prohibits discrimination against service professionals, including on the basis of races, religion, caste, national origin, sexual orientation, sex, marital status, gender, age, identity, or any other characteristic that may be protected under law.

(B) We request that you treat the service professionals with respect and good behaviour and that you provide a clean and safe place for them to do their assigned tasks well. If you are disrespectful, unprofessional, abusive, or inappropriate to someone,As per law, we have the right to take initiative against you and withhold access to the services.

JURISDICTION, GOVERNING LAW AND DISPUTE RESOLUTION

(A) This law shall be governed, constructed, and enforced in accordance with Indian law.

(B) Any controversies, disputes, or conflicts arising out of these Terms shall be resolved by arbitration in New Delhi in accordance with the Arbitration and Conciliation Act, 1996, for the time being in force, which is deemed to be incorporated by references in this clause. The language in arbitration is English. The arbitrator's decision will be final and binding on all parties. Each party to the arbitration shall bear its own costs with respect to any dispute.
